PROGRAM TERMS & CONDITIONS

Please be noted that the following documents provides protection for all participants involved, effective and applicable to Summer 2019, Fall & Winter 2019, Spring 2020 and Summer 2020 candidates enrolling into WONE internship Program.

WONE reserves the right to modify or cancel any statement public made in the information as listed on our website (www.wone-internship) or among any of our promotional material without prior notice.

1.INTERPRETATION

“You” or “Yours” means the participant, applicant.

“We”, “Us”, “Our”, and, “WONE Internship” means WONE Internship (Tradename), presenting WG Education Consulting Ltd.

“Program” means the voluntary work or internship at the organization where you will be volunteering.   You understand that the program enables you to participate in an unpaid internship for a host company.

“Company” means the specific establishment where you will be doing your volunteer work/internship and includes directors, managers, employees, representatives and training. This document applies to all applications made through the program.

  1. MAXIMUM LIABILITY:

Our maximum liability is strictly and solely limited to the Program Fee.

  1. THE PROGRAM.

By paying the program deposit you agree to bound the following terms and conditions:

The program includes an internship with a host company, assistance with your visa application (basic information), welcome orientation, accommodation covering the duration from internship starting date to finishing date, planned program events addressed in event calendar with prior sign-up notices, on-line support from our staff.

  1. OUR UNDERTAKINGS:

In return for receipt of the Program fee, we will undertake the following:

(a) to provide you with a volunteer work or non-paid internship;

(b) to provide student resides that meets the following minimum standards:

A shared twin bed;

with a bed in your bedroom;

with adequate bathroom, toilet and shower facilities;

with bed sheets;

 with gas, electricity and water, for which we will cover the payment of bills to a local regular standard; You will be asked to cover the excessive bill if your expenses on gas, electricity and water has beyond the local standard and which we deem as abnormal. at our own discretion.

for the duration of your internship program. If you wish to stay in the accommodation for a longer period, before or after your internship program, we can attempt to arrange this for you. However, we cannot guarantee any accommodation outside of the period of your internship program, and the cost of any such accommodation is entirely your responsibility. Any possible consequences caused by early arrival check-in without prior notice or late check-out without prior notice is entirely your responsibility. We reserve the full right to ask you undertake the penalty by the housing provider or any other relevant parties.

 

 

(c) to provide contact details of local staff, or alternatively hosting staff in case of any severe difficulties or urgent problems experienced and to facilitate emergency support if necessary;

(d) to provide an induction and welcome talk upon your arrival.

(e) to provide you with visa assistance where necessary.

(f) to organize social events, for you and the other participants, at your destination.

For the avoidance of doubt, we will only be responsible for and are only bound to provide the services and matters set out in Section 3 above.

5.DECISION OF PARTICIPATION:

WONE Internship has full rights to reject, interrupt or terminate your application or enrollment that we deem unsuitable for our Program at any stage of the application and enrolment process, at our own discretion.

6.DEPOSIT AND PROGRAM FEE

 

(a) Your Initial Deposit (“Initial Deposit”) is 600 Euro (EUR or €) regardless of destination.

(b) Upon payment of your Initial Deposit, you agree to fully co-operate with WONE Internship in its attempts to find you a placement and agree to do so until the passing of the Placement Deadline. Examples of non-cooperation include, but are not limited to:

  1. Not actively working with your assigned representatives from WONE;
  2. Skipping or missing scheduled internship interviews;
  3. Not engaging in internship discussions with your Internship Coordinator;
  4. Not responding to WONE Internship communications in a timely manner;
  5. Allowing the placement process to be delayed due to missing agreed payment due dates
  6. Unreasonably refusing internships offered to you.
  7. Dishonesty. This includes fabricating, altering, or misrepresenting academic transcripts, test scores, academic standing, statements made on visa applications, or any other written or oral statement you may make in the process of applying for the Program, for a visa, or for any internship role.

Participants who are deemed uncooperative will be notified by WONE Internship, and may be dropped from the program with no refund given. Such Participants may have the option, at the discretion of WONE internship, to rejoin the Program, provided that they cooperate and participate in good faith.

(c) If WONE Internship is unable to place you in an internship role in your Preference Area before the Placement Deadline, you will be given the option (1) to withdraw from the Program and receive a refund of your Initial Deposit and all other Program payments made by you (“Full Refund”), or (2) to request that WONE Internship continue the search process until you are placed; and if WONE Internship is still unable to place you within the extended time, you will receive a Full Refund (600 EURO).

(d) If your Initial Deposit is received by us less than eight weeks before the Commencement Date, your Placement Deadline will be one week prior to the Commencement Date. This is instead of the usual three weeks.

(e) In order to confirm your place in the program, your remaining program fee is due in 30 days upon your deposit payment date, regardless whether internship spot is confirmed or not. If you are facing financial difficulties, a written requests must be submitted to WONE advisor at info@wone-internship.com to ask for an extension of remaining program fee payment deadline. Our advisory team will review your application carefully and make decision at our own discretion. If approved, at least 50% of your outstanding balance is due in 30 days upon your deposit payment date, regardless whether internship spot is confirmed or not. Any further remainder is due within 21 days after we have confirmed your internship role. If not approved, your remaining program fee is due in 30 days upon your deposit payment date, regardless whether internship spot is confirmed or not.

(f) Late Payment and Penalties: 5% payment surcharge shall be applied to your outstanding amount if your payment is delayed for more than 14 days and less than 30 days. If your payment is delayed for more than 30 days, your penalty is the lesser of 250 EUR or the total 7.5% payment surcharge applied.

(g) In all cases, all program fees must be paid before you travel to your program destination. Participants who fail to meet this requirement, will receive none of the benefits of the Program. This includes, without limitation; placement in a confirmed Program, Program Activities and accommodation.

(f) If your Initial Deposit is received by us less than eight weeks before the Commencement Date, your deadline to proceed with payment of the remaining balance will be one week prior to your start date.

(g) Due to the scarcity of housing in Barcelona, some participants in our Barcelona program are subject to earlier payment deadlines than those described in the paragraph above. If this applies to you, then we will notify you of your revised payment deadlines in writing via email, and the payment terms specified in that email will supersede those described in this document.

(h) You are responsible for covering all and any charges imposed by financial institutions, including foreign transaction fees, and wire transfer fees. This applies to your Deposit, Program Fee and any other transfer to us. If you underpay your Deposit due to such charges, you will make up the balance when you pay the Program Fee. If you underpay by less than 100 EUR (or equivalent), we will collect it from you at the program destination after you have arrived. If you underpay by more than 100 EUR (or equivalent), you must make another payment before arrival. If you overpay by more than 50 EUR (or equivalent), we will refund the overpayment amount to you according to our normal procedures. If you overpay by less than 50 EUR (or equivalent), no refund will be given due to the administrative costs involved.

(i) Some participants may be eligible for a discounted program fee – for example, students enrolled in a university with whom WONE has a formal relationship. If a participant is eligible for more than one discount, then WONE has the sole power and discretion to decide how or whether the discounts may be combined, or if only one discount may be applied.

(j) All payments shall be transferred via Bank Wire Transfer and billed directly by WONE. A transfer note should include your full name for our references.

(k) Participants billed directly by WONE are responsible for maintaining their own accounts. If a parent or other designee will be managing payment of fees on behalf of the participant, it is the participant’s responsibility to ensure that all statements and other billing information are forwarded appropriately.

(l) No processing fees will be assessed by WONE for payments made via wire transfer. Any program fees billed directly to the participant and not paid in full, in accordance with the dates and timelines found in WONE’s terms and conditions, may be sent to an outside collections agency for further collections efforts. Any and all fees charged to WONE relating to the collection of a participant’s outstanding balance will be added to the participant’s WONE account balance and will be the responsibility of the participant to pay in full.

  1. REQUEST TO CANCEL, VARY PARTICIPATION ON THE PROGRAM AND REFUNDS

(a) WONE reserves the right to cancel an Internship Program due to insufficient enrollment or other factors beyond its control. All WONE programs are based on group arrangements involving a minimum number of participants. In the unlikely event that a program is cancelled prior to the start of the program, due to low enrollment or any other reason, WONE will refund all payments received but will have no further liability to participant.

If an emergency requires that a program be canceled following the program start date and prior to the end of an internship program, WONE will make reasonable efforts to make alternative arrangements in order to allow students to complete their internship program, but cannot guarantee that full or partial credit will be obtained. If alternative arrangements cannot be made, WONE will make reasonable efforts to collect documentation of student work completed to date. WONE will share this information with the home institutions of students enrolled in the program so they will be able to evaluate, per home institution policies, whether to grant their students any, full, or partial credit for work completed.

(b) If you wish to withdraw from the program at any time, then this must be done via a written request to info@wone-internship.com. For the avoidance of doubt, such a written request must be made by email. Once your application is submitted, WONE advisor team will look into your case and make a decision at our own discretion.

(c) The Deposit, and all subsequent Program Fees paid, are not refundable if you withdraw from the Program for any reason other than WONE’s failure to place you by the Placement Deadline in your Preference Area. This includes withdrawal for medical, personal, family, academic, financial, and all other reasons. The Deposit, and all subsequent Program Fees paid, are refundable ONLY if WONE fails to place you in an internship role, in your Preference Area, by the Placement Deadline, as defined in this document.

(d) The Deposit, and all subsequent Program Fees paid, are not refundable if WONE determines, in its sole discretion, that you did not fully co-operate in the placement process at any time before the Placement Deadline, as further detailed under section 3(b) above.

(e) If you withdraw from the Program for any reason after being placed in an internship role, WONE will be entitled to 100% of your Initial Deposit and either 100% of the subsequent payment(s) you made after the Deposit or 50% of the Program Fee, whichever is greater. If the withdrawal takes place less than 21 days before the Commencement Date, WONE will be entitled to 100% of your Initial Deposit and 100% of the Program Fee.

(f) If you want to change the start or end date of your participation in the Program after being placed with a partner organization, a change fee of  250EUR may be charged. If such a request is made within 21 days of the Commencement Date or after an invitation letter has been issued, we reserve the right to refuse the change request or to apply an additional charge which shall be determined at our sole discretion.

(g) In the event that, for any reason at all, you decide to discontinue your place on the Program after it has started but before it is due to end, no refund will be given.

(g) If, for whatever reason, we have to cancel your participation in the Program, prior to your commencement date, a full refund of the Program Fee (for the avoidance of doubt this includes the Deposit) will be given to you. A full refund will be issued only if the cancellation is for reasons which are in no way whatsoever attributable to you. No compensation can be given for any other costs incurred in relation to the Program.

(h) In the event that you are refused an appropriate visa or suitable alternative by the Local Authorities, a full refund of the Program Fee and the Deposit will be paid if; (1) you filled out all and any visa forms correctly, and (2) completed all steps in the required visa process correctly and on time. No compensation can be given for cancellation of flights or any other costs whatsoever incurred by you. No refund of Deposit and/or Program Fee will be offered if your tardiness in completing the necessary visa requirements leads to start dates being delayed and your internship being cancelled; or due to your lack of co-operation facilitating the VISA application process with WONE.

(i) All refunds are paid via bank transfer.

(j) We do not withhold any processing fee or service charge from refunds. However, the refund amount you receive may be less than you expected, due to fees or charges imposed by your bank or by other intermediary financial institutions. We have no control over this and cannot cover or reimburse these fees.

(k) Any refund must be initiated within 6 months after the internship program start date selected by the participant. After this date, refunds are made solely at our discretion.

(l) All refunds and reimbursements will be processed within 30 days.

8 THE FORMAT OF THE PROGRAM

We reserve the right to change our suppliers and the format of our Program as and when necessary, however we will endeavor to provide as similar a program as possible at all times.

  1. LIABILITY FOR LOSSES AND PROGRAM CHANGES

(a) We cannot accept any responsibility or liability for loss of or damage to your passport, supporting travel documents, important personal belongings or any other personal property at any part of the visa process, during transit or during registration with the Local authorities.

(b) We cannot accept any responsibility or liability for Program changes or Program cancellations under any of the following circumstances; war or threat of war; terrorism or threat of terrorism; fire; sickness; environmental or climate concerns; acts of government or local authority; or, any other event or circumstance which amounts to a “force majeure” and in such cases no refund or compensation for any loss will be given to you unless otherwise decided at our sole discretion.

(c) We cannot accept any responsibility or liability for personal belonging losses, robbery, theft, damage and other reasons prior arrival, upon arrival, during, and completing the program. You are solely responsible to take care and look after your belongings.

(d) WONE is not liable for the services between the applicant and the arranged companies. The company is only liable in case of gross negligence and intent.

(e) WONE excludes completely liability for events that are not in its field of responsibility (e.g. granting of subsidies, insurance benefits, etc.)

(f) All activities before, during and after the stay (including activities within the limits of WONE) are undertaken at the applicant‘s own risk. Every applicant has to have sufficient health, liability and accident insurance for the duration of his/her internship and stay abroad.

(g) WONE is not liable for damage done by third parties, particularly general traffic, crime and life risks.

(h) the applicant exempts associate offices of WONE from potential claims of damages by third parties caused by the applicant during his/her stay abroad. The applicant is responsible for fulfilling the respective country‘s entry requirements (Visa). If the visa is not granted or issued in time, the applicant bears all emerging costs (e.g. the placement fee, cancellation or rebooking fees for the flight). We also explicitly point out that a change of the internship is only possible once and that associate offices have the right to exclude the applicant from further services in case of gross offences against the code of conduct of the company providing the internship or of WONE Internship and its employees are exempted from all liability completely.

  1. YOUR RESPONSIBILITY

(a) It is your responsibility to be aware of any national holidays or other events that may change the nature of the Program. While most companies operate a 9-5 working policy, some may have different requirements and we cannot be held responsible for this.

(b) International flights are not included in the cost of any of our Programs. It is your sole responsibility to arrange flights and insurance and to select providers based on your own decisions and experiences. We cannot be held responsible for any action, negligence or event relating to the purchase or operation of flight tickets or flights. We will also not be responsible for any costs or refunds due to changes or delays in flights.

(c) You are responsible for considering your personal health and safety needs when applying for and participating in the Program. WONE retains the right, in its sole discretion, to refuse an applicant if the applicant’s participation in the program may indicate any risk to the applicant’s own health and safety or to the health and safety of others.

(d) Read and carefully consider all materials made available that relate to safety, health, legal, environmental, political, cultural and religious conditions in your host town. Be aware of local conditions that may present health or safety risks when making daily choices and decisions.

(e) You must maintain weekly contact with Local Coordinator.

(f) Driving or purchasing a motorized vehicle (car, motorcycle, boat, or any other vehicle requiring a driver’s license) is prohibited. Driving is permitted with the instructor of an official driver’s education course and only during class hours. This is solely for the purpose of obtaining a driving license and does not allow the student to drive after a license is obtained.

(g) Students may be dismissed from the program if they suffer from a life-threatening medical condition or debilitating psychological condition.

(h) Refrain from obscene, indecent, violent or disorderly conduct while on the program. Students shall also refrain from perpetrating any form of sexual harassment, or engaging in any self-endangering behaviors. In addition, students shall refrain from any other conduct likely to bring the local government or WONE into notoriety or disrepute.

(i) Abide by the local laws of the hosting country / region. Be aware of these laws,and be mindful that they may be different from laws in your home country and that violations may lead to serious punishment.

(j) f Your visa is delayed or You do not receive Your visa before Your Program Start Date, We will not be responsible and You shall not hold Us responsible for any costs incurred by You, including but not limited to flight change fees.

(k) If You choose to process Your own visa:

  1. You must sign up for the Program in full at least twelve (12) weeks before Your Program Start Date, and You must inform Us in writing of the outcome of Your visa application at least four (4) weeks before Your Program Start Date.
  2. We are not obligated to assist You with the visa process, nor to supply You with any documentation other than an invitation letter in support of the visa application.
  3. If Your visa application is unsuccessful and You do not inform Us of the outcome of Your visa application at least four (4) weeks before the Program start date, You will not be able to participate in Your Program and We reserve the right to unilaterally cancel Your Placement and no refund of fees will be made.

 

  1. EXPERIENCE PROBLEM

(a) WONE wants you to enjoy a worry-free program. Should you experience any problems while participating in our Program, you must immediately inform us in writing (by email or post), with a clear explanation of the problem. In such an event, we will discuss the problem with you and will discuss ways in which the problem can be solved. We are not responsible for any conversations or anything that is said unless it is recorded in the written form either by email or by letter.

(b) You fully agree to discuss any problems in your placement with our staff prior to discussion with your internship provider. If the assigned internship provider wishes to terminate your placement prior to the end of the stated time for any reason (for example as a result of your inadequate or unhelpful participation or prolonged or repeated absence from work), you understand that no refund of fees will be given in this situation and we are under no obligation to provide another placement. In such a case, you will be required to leave the provided accommodation within two days of being informed by us.

(c) If you wish to terminate your placement prior to the end of the time stated in the contract for any reason you must provide us with written notice, clearly stating the reasons for such a decision. You agree that no refund of the Program Fee or any other fees will be made in this situation, that no other placement will be offered and that you will be required to leave the provided accommodation within two days of being informed by us.

(d) WONE cannot be held responsible for any complaints arising from issues outside of the specifications made in Section (1)(b), this includes, without limitation, relations with other inhabitants of the apartment/residences, relations with your neighbors, and relations with other colleagues or managers in your place of internship.

(e) WONE cannot be held responsible for any complaints arising from issues related student residence apart from its providing. A request on change, transfer or cancel residence due to external reasons such as location, exterior environment, relations with other inhabitants are strictly forbidden. If you insists to request such a change, you must cover your own expenses fully for the program dates that are stated in your program enrolment details in order to initiate the change.

(f) WONE retains the right to terminate your program participation if the candidate insists on such a change of residences without valid reasons as stated in section 11(d)(e) and/or refuses to co-operate with our team on covering own expenses fully to initiate a change. No refund shall be refunded given such a termination.

  1. SAFETY

(a) We, our affiliate agencies, suppliers and members of staff cannot be held responsible for any case of small accident, physical injury, accident, claim, theft, damage, sickness, cancellation or loss, in relation to our/their services.

(b) You are responsible for your own safety during the trip and neither we, nor the assigned internship provider, take responsibility nor can be held liable for any accident, sickness, loss, damage, expense or hazard encountered throughout the Program.

(c) You will be held responsible and liable for any damages to the assigned internship provider during your placement. It is your sole responsibility to ensure you purchase personal liability insurance prior to the Commencement Date.

(d) You will be responsible to present and make sure a travel insurance covering the entire program date including the date you enter the internship destination and the date you return to your home country. You are requested to present your travel insurance coverage to WONE team prior to your arrival date.

(e) WONE has no relations or whatsoever with your flight purchase, insurance plan, insurance provider, coverage or offering. Nor will WONE make any possible claim for you on your behalf.

  1. COMPLYING WITH RULES, LOCAL LAWS AND ACTING RESPONSIBLY

(a) If you do not comply with the rules of the internship provider, the rules of our Program, or the laws of the destination to which you go, then we may release you from the Program. In these cases, no refund will be given and you will be required to leave the provided accommodation within two days of being informed by us. This includes cases in which the internship provider asks you to leave your role due to underperformance or misconduct.

(b) You agree to take absolutely full responsibility for your own conduct at all times prior, during and after the Program. You will not act irresponsibly nor will you break the law, violate policies of the country to which you go. You will not put yourself or others in dangerous situations. If you do any of the above you will be responsible for the consequences.

(c) We reserve the right to expel, at our sole discretion, any Participant from the Program for reasons including but not limited to: breaking the law; bullying or harassment of other Participants; anti-social or unreasonable behavior or unfit conduct towards other group members, harassing our representatives and staffs, our suppliers’/affiliate agencies’ representatives or the assigned internship provider, unreasonable demand from the program, false claim of information to University / the third Party, or excessive absence from work. Whether a Participant has acted in any of the ways set out above will be determined by us in our sole discretion. In such instances, we retain the right to immediately remove the Participant from his or her accommodation and cancel their participation in the Program, with no refund issued.

  1. THIRD PARTY BEHAVIOR OR ACTIONS

(a) We take no responsibility and are not liable for any third party behavior or actions including but not limited to that of the host internship provider and accommodation provider. We take no responsibility and are not liable for any accidents that take place at any third party locations including but not limited to the premises of the host internship provider and the designated accommodation. It is your responsibility to ensure you purchase personal liability insurance prior to the Commencement Date.

(b) We reserve the right to make charges for any missing or damaged items or for any additional cleaning or repair charges to accommodation that may be incurred during the Program. You agree to pay these charges in full to us within 14 days of finishing the Program.

  1. GUESTS PROHIBITED

(a) You are not allowed to have any overnight guests to stay in your accommodation. In the event that guests stay in residence without consent from the homeowner, you may be required to leave the provided accommodation within 48 hours of being informed by us.

  1. INSURANCE

(a) You are responsible for ensuring that you have purchased full, comprehensive insurance prior to departure, which will cover you for the duration of your participation in the Program, and which includes but is not limited to travel, health, medical and accident insurance.

(b) Even if you have insurance coverage through another party, such as your university or your visa sponsor, you are responsible for ensuring that the coverage is sufficient. If you have any doubts or questions about your insurance, please contact us.

(c) You must bring all relevant insurance documents with you to the country in which you are placed.

(d) You will be responsible to present and make sure a travel insurance covering the entire program date including the date you enter the internship destination and the date you return to your home country. You are requested to present your travel insurance coverage to WONE team prior to your arrival date.

(e) WONE has no relations or whatsoever with your flight purchase, insurance plan, insurance provider, coverage or offering. Nor will WONE make any possible claim for you on your behalf.

  1. HOUSING SECURITY DEPOSITS

(a) Please note that in Spain, a security deposit will often be required by our housing provider. They will request this on arrival and will fully reimburse you at the end of the program assuming there are no damages to your room. If you are eligible to receive a full/partial refund for your housing deposit, it is your responsibility to collect it. We will not be held responsible if you leave your deposit in country, and we will not cover any fees associated with transferring the funds back to you.

(b) In an event that WONE has pre-settled the security deposit for your room, a security deposit may not be applicable. You are aware that any damages caused on housing related to facilities, cleaning and maintenance will be charged and billed to you directly by housing provider.

(c) You agree to pay in full any housing damage fees stated in section 15(b) if caused, investigated and confirmed by our housing provider and remain honest regarding the rooming situation upon checking out. WONE is not responsible for any damages or potential damages caused by you in any scenario.

(d) You agree to inform the housing provider within the 1st week upon arrival an update regarding the rooming if there is any damages or unusual situation that has already existed in the rooming provided for you. You agree to confirm with the housing provider by participating a double check. You agree to cover the possible damage fee if you fail to inform the housing provider upon the 1st week and that the damage fee is billed to you and are liable to you as a tenant.

(e) You agree to keep the room clean and tidy, perform a general cleaning upon checking out. You agree to empty the trash, taking off any stickers on the wall, or anything additional that differs from the checking-in condition. You are aware and agree to pay for the fine or damage charge due to lack of cleaning of the room upon checking out.

(f) You are aware and agree that an excessive use of gas, water, electricity or A/C may cause an additional bill to your residence. If we inspects the situation to be excessive, we ask you to settle for the payment of excessive gas, water, electricity bill. You are also aware of the difference in using standards of such resources of local program location to your home country. You agree to settle the further charges we or housing provider billed to you.

  1. NON-DISCLOSURE AGREEMENTS

(a) In instances where the assigned internship provider demands it, you agree to sign a Non Disclosure Agreement with the assigned internship provider. Regardless of whether or not the assigned internship provider requires a written Non Disclosure Agreement, you agree to respect and keep confidential the intellectual property of the assigned internship provider.

  1. WORK

(a) We are not responsible for the workload provided by the internship provider whether it is of a high intensity or low intensity. In such situations, you should discuss the problem with us and we will endeavor to resolve the issue accordingly.

(b) Any requests asked upon change, switch or cancel your internship spot due to working hour condition, starting hour, finishing hour or intensity must be submitted to WONE advisory team for a preview. If you fail to do so and manage it on your own without our notification, you agree to be removed from WONE Program with a two day notice, including checking out of your residence and no refund shall be provided.

(c) You are aware and agree with that any unreasonable and subjective complains about your work tasks will not be attended.

(d) You agree to arrive and leave the office at the agreed hour with internship provider and properly communicate with the hosting organization regarding any late-arrival or early-leave.

(e) If you are making a sick claim, a doctor appointment letter must be presented and submitted to Internship Provider via Email or in person.

(f) Tardiness, lateness or absences at work is not allowed. An absence from work of 5 working days may result in a termination of your program spot. You agree to be removed from WONE Program with a two day notice, including checking out of your residence and no refund shall be provided in such situation.

(g) You agree to communicate with WONE advisors before speaking to your internship provider, University organizer when there is an immediate event associating your experiences with workload, colleagues or worksite.

(h) You also agree to make 100% honest, true statement about the situation in section 17(g) and WONE retains the full rights to investigate in the situation. Any dishonest, misleading information provided by you for personal reasons initiating a change of your internship tasks, program dates or internship companies may result in a termination of your program spot and we shall inform your University and hosting organisation in this case.

  1. NOTIFICATIONS YOU MUST MAKE

(a) You must inform us if you have an infectious disease, mental illness, or a criminal record, as any of these may complicate your visa application or immigration status in your destination country.

(b) You must inform us of any travel abroad or any other unavailability of passport for visa processing during the 4 weeks prior to the Commencement Date. You must inform us of any unavailability of passport in this period at least 2 months before the Commencement Date. We cannot be held responsible for additional costs for express processing, postage, submission in person by our staff, or delay or cancellation of program due to failure to inform us of such details.

(c) The Participant is responsible for informing WONE of any medical conditions (physical or psychological) or religious restrictions which may influence the Participant’s ability to complete the Program (work in their internship or attend any events or activities), prior to paying a Deposit. For medical conditions and religious restrictions which have been disclosed, it is WONE’s responsibility to inform the Participant whether they can continue with the Program prior to commencement – if this is not possible then a full refund of the Deposit will be given. If the assigned internship provider wishes to terminate your placement prior to the end of the stated time for reasons related to your medical conditions or religious restrictions, you understand that no refund of fees will be given in this situation and we are under no obligation to provide another placement. In such a case, you will be required to leave the provided accommodation within two days of being informed by us.

19.LATE ARRIVAL TO A PROGRAM

Students are required to be present from the first day of the program orientation. In extremely rare cases, there may be valid academic or personal reasons for a student to arrive late. Permission for such arrangements can only be granted by the appropriate WONE member in Barcelona and only upon receipt of a written request from the appropriate officer at the student’s home institution. In no case are such arrangements authorized directly by Resident Directors/Mentors.

  1. STUDENT PROGRAM ORIENTATION

The home institution will typically provide informational material covering relevant academic matters prior to the student’s departure. It is the sole responsibility of the student to be familiar with this information and the policies of the home institution.

Prior to the program start date, students are required to read the WONE pre-departure orientation that WONE will send to the students. A more extensive WONE orientation takes place at the program site, which all students are required to attend.

  1. DRUG AND ALCOHOL POLICY

Students are subject to the laws of the host country and any policies and regulations of the host university. Drug or alcohol abuse by students is viewed by WONE as a serious violation of the terms of participation and can result in dismissal from the program.

  1. DRUG AND ALCOHOL VIOLATIONS

Penalties for drug violations in many host countries are often harsh. Use of drugs other than prescribed drugs for legal medicinal purposes may result in expulsion from the study program, as well as possible criminal prosecution. Students traveling abroad are subject to the laws of the country they are visiting – their own country’s laws do not protect them.

  1. HONESTY

WONE requires that students exhibit the highest standards regarding honesty conduct at workplace and providing information & feedbacks. Standards of honesty and norms governing originality of work differ significantly from country to country. We expect students to adhere to the local norms.

Three important principles are considered when defining and demanding honesty. These are related to the fundamental tenet that one should not present the work of another person as one’s own.

The first principle is that student agrees to provides us important personal information (documents requested, important updates on personal matters such as infectious disease or matters associated with mental health, and so on). Student agrees to remain truthful on the all the documentations presented to WONE team. Any matters such as fabricating information, lack of sharing, hiding information, ignorance of important items, undersharing or twisting information that we should to know, shall be considered as dishonest conducts.

The second principle applies specifically to internship work: Students are expected to perform full hours as agreed and maintain an honest conduct at the internship worksite. This includes respecting non-disclosure agreement with the hosting organization regarding their business information or technology, company agreement information details, do not fabricating personal reasons for justifying absence or late of work, do not provide work deliveries that are not made by you, remain honest feedbacks to your internship provider and WONE team regarding your internship experience information.

The third principle is that any claims, complains or feedbacks related to WONE program undertakings, inclusive to residence, residence facilities, program activities, internship providers, WONE program staffs and WONE’s terms & conditions (in additional further policies and agreement) are remaining 100% true and honest. It is also not under revealed. You also agree to make 100% honest, true statement about the situation in section 17(g) and WONE retains the full rights to investigate in the situation. Any dishonest, misleading information provided by you for personal reasons initiating a change of your internship tasks, program dates or internship companies may result in a termination of your program spot and we shall inform your University and hosting organization in this case.

WONE takes candidate’s honest conduct seriously and will remain full rights to make decision regarding your placement spot, housing spot and other program undertaking affected due to dishonest conduct. You will be fully and legally responsible for any damages to WONE’s brand reputation, internet reputation, client relations or internal communication with other participating candidates caused by your dishonest behavior, comments, false claim, under claim or possible manipulative action (if any).

  1. Internship Agreement

Relations between the applicant and the company offering the arranged internship are defined by a separate internship agreement.

  1. Placement Procedure

Placement procedure by WONE starts after a detailed telephone interview with the applicant and upon receiving the signed agreement.

In principle, placement will be concluded after 3 months at the latest. In case the applicant refuses the first offer, a second placement attempt can be started (after consultation with the applicant about the refusal reasons).

In case of the acceptance of a second placement attempt by WONE the placement will be concluded within 6 weeks. In case of the acceptance of the application by WONE  the placement contract is conducted for a period of 3 months, regardless of the desired internship start.

If WONE receives the application less than 3 months prior to the desired starting date of the internship, a placement in time cannot be guaranteed.

In this case WONE only falls behind the placement service 3 months after receipt of the application. If the placement procedure is finished within these 3 months, WONE will stay entitled to consideration.

  1. Insurance & Flight
  1. a) You are responsible for ensuring that You have purchased full, comprehensive insurance prior to Your Program start date which will adequately cover You for the duration of Your Program.
  1. b) Your insurance should include repatriation, cancellation, travel, health, medical (including pre-existing medical conditions) and personal liability insurance.
  1. c) You must provide Us with all relevant details about Your travel insurance policy.
  1. d) You must bring all relevant insurance documents with You to the Program location.
  1. e) Neither We nor Our employees are liable for any medical advice given by Ourselves or third parties.
  1. f) It is Your responsibility to claim any expenses directly from Your insurance provider. We will offer You reasonable assistance to complete forms where We deem it appropriate but We cannot be held liable for any financial loss You encounter in relation to the accuracy of Our assistance.
  1. g) If You choose to travel without adequate insurance cover, We will not be liable for any losses howsoever arising in respect of which insurance cover would otherwise have been available.
  1. h) Flights are not included in any of WONE’s programs.
  1. i) You must purchase Your own flight tickets to arrive in the Program location by Your Program Start Date.
  1. j) We are not responsible for any damages or costs due to any act, omission or negligence relating to the purchase of flight tickets or the operation of flights or any other form of transport.
  1. k) We are not responsible for any costs You incur due to changes or delays in flights, trains or any other form of transport.
  1. Serious accidents, disease, severe physical or mental injury or death

(a) We cannot accept any responsibility or liability for loss of or damage to your passport, supporting travel documents, important personal belongings or any other personal property at any part of the visa process, during transit or during registration with the Local authorities.

(b) We cannot accept any responsibility or liability for any accidents, disease, severe injury or death caused under any of the following circumstances; war or threat of war; terrorism or threat of terrorism; fire; sickness; environmental or climate concerns; acts of government or local authority; or, any other event or circumstance which amounts to a “force majeure” and in such cases no refund or compensation for any loss will be given to you unless otherwise decided at our sole discretion.

(c) We cannot accept any responsibility or liability for personal belonging losses, robbery, theft, damage and other reasons prior arrival, upon arrival, during, and completing the program. You are solely responsible to take care and look after your belongings.

(d We cannot accept any responsibility or liability for any accidents, disease, severe physical or mental injury or death due to a candidate’s personal reasons prior to, during or after the program.

  1. Data Protection and Data Sharing

 

You agree that We may collect and process Your personal data in accordance with the terms set out in our Privacy Policy.

You agree that We are the data controller and our instructed suppliers (including Host Organizations and visa processing agents, travel agents, accommodation providers and universities) are the data processors in respect of any personal data you may provide to Us in connection with Your Program.

Our suppliers shall only process the personal data in accordance with Our instructions from time to time and shall not process the personal data for any purposes other than those expressly authorized by Us.

During your program we may undertake activities to collect material, including but not limited to photographs, videos, oral and written comments, which may we may use for marketing purposes free of charge.  You may let us know at any point if you do not consent for your specific image or content to appear in marketing or other materials and we will take reasonable and appropriate action to ensure this happens.

29.Health and Safety Information; Duty to Investigate.

You acknowledge that You have read and understood the health and safety information provided in the application materials, as well as the health and safety information concerning travel to the Program location, including current terrorist warnings, travel advisories and health advisories, provided by the US Department of Homeland Security (DHS) (http://www.dhs.gov/dhspublic), the U.S. Department of State (DOS) (http://www.state.gov), and the US Centers for Disease Control (CDC) (http://www.cdc.gov) (collectively the “Health and Safety Information”).  You further understand and agree that if you would like to inquire about or have concerns regarding the health and safety conditions associated with any particular country, area, environment, service, transport, carrier or activity, as well as any medical issues (such as immunization), WONE, upon Your request, will refer You to third parties such as governmental agencies or professional organizations in the Program’s home country(ies) or the Program’s host community(ies).

You understand that You are responsible for investigating and evaluating the health and safety risks that You may face, including but not limited to inherent risks. This responsibility includes, but is not limited to, the responsibility for (1) reviewing the Health and Safety Information for periodic updates, and (2) consulting with a physician or appropriate specialist for advice on the risks in the Program-related travel and recommendations for appropriate precautions for Participant.  You further agree that it is Your responsibility to take the precautions recommended by the DHS, DOS, and CDC to minimize health risks, including, in the case of insect-borne disease (e.g. Zika), wearing protective clothing and applying proper insect repellant when You will be outdoors.

 

30.Medical Conditions; Medication.

 

You agree to report to the WONE local office coordinating Your Program any physical or mental condition You have, which may require special medical attention or accommodation during the Program as early as possible, but no later than sixty (60) days prior to the Program start date.  You specifically understand and agree that We cannot be held responsible for any consequences arising from pre-existing medical, emotional or other conditions and dispositions of Participant, including but not limited to ailments, trauma, depression, eating disorders or dietary habits. 

We will use reasonable efforts to accommodate physical or mental conditions you have disclosed to Us in a timely manner, including suggesting alternative programs or program locations which may better suit your needs.

If You did not give Us full details of any physical or mental conditions that You are aware of prior to Your Program Start Date or any physical or mental conditions that You become aware of during Your Program, We may, at Our sole discretion, cancel Your Program and impose applicable cancellation charges.

You understand and agree that if You will need any medications during the Program it is Your responsibility to bring an adequate supply of these medications. You understand that some medications may not be available in some countries of destination, and that it may not be possible to promptly receive these medications by mail.

 

31.Third-Party Suppliers; Changes to Program; and Responsibility.

 

WONE will make reasonable efforts to identify quality suppliers, where applicable to the Program, of accommodations, food, transport, travel, tours, recreational or athletic activities, service learning/experiential learning sites, academic/educational activities, and other goods and services related to the Program (“Suppliers”).  You understand and acknowledge that WONE does not represent or act as an agent for, and cannot control the acts or omissions of, any Program Suppliers.

You agree that WONE may, in its sole discretion, make any change in any part of the Program it deems necessary.  You understand and acknowledge that WONE is not responsible for any disruption in travel arrangements, or any consequent additional expenses that may be incurred therefrom, including lost baggage.

WONE may substitute accommodations or housing of a similar category at any time.

You agree that WONE is not responsible for any injury Participant may suffer while traveling independently before, during or after the Program.

 

  1. Voluntary Assumption of Risks. You understand that Your participation in the Program is wholly voluntary. Although WONE has made every reasonable effort to assure Participant’s health and safety while participating in the Program, there are unavoidable hazards and risks inherent in travel to and from the Program location and the activities included in the Program, including but not limited to those described in the Health and Safety Information and those associated with: (a) foreign political, social and economic conditions which are different than Participant’s home country and which can change in an unpredictable manner; (b) different standards of design, safety and maintenance of buildings, computing facilities, public spaces and transportation; (c) varying quality of available medical treatment and differing health, safety, legal, cultural and religious beliefs and conditions; (d) war, terrorism, crime, civil unrest, kidnapping, illness, public health risks, accidents, acts of God and/or violence; and (e) other possibly dangerous conditions beyond the control of WONE, all of which could cause serious personal injury or loss of life to Participant and/or loss or damage to Participant’s property overseas.  You are aware of and understand the foregoing hazards and risks and You hereby assume, knowingly and voluntarily, each of the risks described above and all of the other risks which could arise out of or occur during Participant’s travel to, from, in or around the Program location.

33.Release and Indemnification.  You, individually and on behalf of Your heirs, successors, assigns and personal representatives, hereby release and forever discharge WONE, its employees, agents, officers, directors, and representatives (in their official and individual capacities) (the “WONERepresentatives”) from any and all liability whatsoever for any and all damages, losses or injuries (including death) Participant sustains to Participant’s person or property or both (“Losses”), including but not limited to any claims, demands, actions, causes of action, judgments, damages, expenses and costs, including attorney’s fees, which arise out of, result from, occur during or are connected in any manner with Participant’s participation in the Program, any related or independent travel, or any activities or excursions, irrespective of whether they are sponsored, supervised or controlled by the WONE Representatives, except for such Losses as may be caused by the gross negligence or willful misconduct of the WONE Representatives.  You also agree to indemnify and hold harmless the WONE Representatives from and against any Losses.

  1. OTHER TERMS

(a) The rights of the parties to terminate, rescind or agree any variation, waiver or settlement under the Agreement is not subject to the consent of any person that is not a party to this agreement.

(b) The Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including no contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

(c) Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Agreement or its subject matter or formation (including non-contractual disputes or claims).

(g) We reserve the right to amend this document from time to time.

Waiver and Release

You hereby indemnify WONE Internship against any and all liability, loss, costs or damages that may be incurred as a result of claims or charges made against us, whether at the instance of a third party or yourself, related to any injury, illness, loss, damage, harm or death of a third party or yourself may suffer arising out of your participation on the Program and/or arising out of your participation in any Program-related or non-Program-related activity.

Governing Law

  1. These terms and conditions and this agreement shall be governed by, and construed in accordance with, Hong Kong law. Any dispute, controversy or claim arising out of or relating to these terms and conditions or this agreement, including the validity, invalidity, breach or termination thereof, shall be settled by arbitration in Hong Kong under the Hong Kong International Arbitration Centre Administered Arbitration Rules in force when the Notice of Arbitration is submitted in accordance with these Rules. The number of arbitrators shall be one. The arbitration proceedings shall be conducted in English.

  2. You hereby confirm that you have read and fully understand this agreement, intend that this agreement be legally binding upon and enforceable against you and your family, estate, heirs and legal representatives, intend that this agreement benefit us, and confirm that you are at least eighteen (18) years old, or a parent or legal guardian of an applicant under 18, fully competent, and entering into this agreement voluntarily of your own judgment.

  3. You understand that this is a legal document. You have read and understood all of the terms of this agreement and voluntarily with full knowledge of its meaning and significance you sign this agreement.
